China has new Internet regulations

The Cyberspace Administration of China (CAC) issued the Regulations on the Administration of Internet Group Information Services, which will be implemented on October 8, 2017. With the rapid development of mobile Internet, the Internet group has facilitated people’s work and life and enhanced the spiritual and cultural exchanges. At the same time, however, some obscene pornography, violent terror, rumors, scams, pyramid schemes and other illegal information have also spread through the group. Some criminals even use the group to implement criminal activities, damaging legitimate rights and interests of citizens, legal persons and other organizations.

According to the Regulations on the Administration of Internet Group Information Services, group information service provider refers to the platform that offers Internet group information service; Internet group information service users include group creators, administrators and members.

The Regulations clearly regulates that the group information service providers should perform their duty as security administrator of information security. It should be equipped with professional staff and technical capacity adapting to service scale, establish sound management systems of user registration, information audit, emergency response, security and others.

At the same time, the group information service provider should authenticate the real information of the users, establish the credit rating management system, set the group size reasonably, implement the classification management and take necessary measures to ensure the safety of users’ personal information.

The Regulation requires that Internet group creators and administrators should fulfill the group management responsibilities. In accordance with laws and regulations, user agreements and platform conventions, they should standardize group network behavior and information release. When Internet group members exchange group information, they should abide by the relevant laws and regulations and have civilized interaction and rational expression.
